>> abc7 news starts right now with breaking news. >> the breaking news is from east san jose, a massive police search for a gunman who tried to problem a check cashing business. we were overhead where you can see dozens of police cars. >> a large door do door search is underway for the suspect for several hours. moments ago a major break. abc7 news matt kellerer joins us. matt? >> five minutes ago it was confirmed that a suspect was captured inside this neighborhood.

you can see police officers are coming out from the neighborhood. police say people are now free to leave their home. a man confronted an employee in the check-cashing store and demand crash. he fired shots from a hand gun before running north in the neighborhood the no one was hurt. police arrived and blocked off the area not letting anyone in or out. police say the armed robber was seen jumping fences. neighbors witnesses officers and s.w.a.t. team members with guns drawn. the big concern is the missing handgun. they are now searching for that. police believe that there is no second suspect. they have the only person responsible for this armed robbery. as we come back out here it will take some time for officers to bring the suspect out and to clean up the scene. the road is blocked off right now but a suspect was captured in the last half hour. they are expected to bring him

out. >> breaking news, convicted cleveland rapist makes shocking statements this morning before he was sentenced for the kidnapping and imprisonment of three women. abc7 news reporter katie marzullo is in the newsroom. a victim spoke? >> she did, michelle knight faced the abuser and she was strong and defiant and castro spoke for 20 minutes, a dramatic moment when michelle knight entered the court room, around 9:00 this morning after a brief recess in the hearing. then was tremendous came back in the courtroom. she told the judge no one should ever have to go through what she went through not even her worse enmy, castro denied ever abusing michelle, amanda berry or gina dejesus. years. >> we have breaking news from richmond, city council member has died. he was in a medical coma after he was hospitalized for a severe bacteria sinus infection. he won a seat on the city council but never sworn in because of the illness. he passed away around 1:00 o'clock a.m. at 54 years old. >> turning thousand to the threat of a bart strike we are going to know in hours whether a 72 hour street notice will be issued that could come tonight if progress isn't made on the contract nexts. abc7 news reporter amy hollyfield joins us from oakland where the talks will resume in the hour. amy? >> negotiations are continuing but the tone seems to be changing, the unions today rather than talking specifics like wages, are talking about a bigger picture, saying that this is all about busting up the unions. the transit union is wrapping up a press conference right now and

they brought in transit officials from arizona and massachusetts to talk about bart's chief negotiator claiming that he is just here to say "no," not to negotiate. a bart spokesman calls this a distraction. the negotiations continue but at 5:00 today the unions are all going do come together, they will get up from the negotiating table and hold a rally. they calling to a pep rally, >>dave: it to speak out against what they call a direct attack on workers' rights. >> a rally unites people and when you are not alone it is easier to stand up and say, it is fought right. >> the general feeling is that bart trains will not be running on monday. that is not official. union workers tell me that is their prediction. they do think that they will be on the picket line on monday as they were a month ago.

investigators say the woman in her 20's was walking home to her apartment from a 7/11 and a man grabbed her from behind. the woman turned around and kick add man in the groin and ran away. police traced the attacker on to campus and still looking for him. >> in contra costa county, the parents of an 11-year-old boy sexually abused by a former teacher have filed a massive claim against the school district the first step in a lawsuit. 45-year-old joseph martin was charged with 91 physical any -- felony counts of molestation and leaded not guilty. he taught 4th and 5th grade in concord. this 11-year-old parents claimed the officials failed to prevent the abuse by mishandling the case against martin. >> developing news, in antioch police are looking for the person who pulled a trigger on two men in a car leaving one

dead. officers responded to reports of shots fired near the delta fair shopping center. police found a white pontiac a couple blocks away with two men inside, one from richmond. he died at the scene. the other man was rushed to the hospital. they are hooking for a suspect vehicle possibly a gold-colored four-door honda or chevrolet. >> a baggage handler charged with stealing from checked luggage at san francisco international airport is due in court this morning. the 45-year-old george reyes was arrested in may after police say they traced stolen items to his him. an investigation was launched in march when passengers started reporting missing electronics from the luggage. the hearing could result in setting a new date if a preliminary hearing. >> coming up next on abc7 news, edward snowden is on the move. the n.s.a. leaker has finally left the moscow airport and
